The Central Bank of Ireland fined Coinbase Ireland €3,252,618 on Oct. 22 for failures in safeguarding customer funds and overseeing outsourced services, raising concerns about whether customers could recover money promptly if the firm became insolvent, according to the Central Bank’s announcement. As an e-money institution, Coinbase Ireland was required to keep customers’ funds protected in designated safeguarding accounts.
How did the safeguarding failures happen?
The Central Bank’s settlement notice says Coinbase Ireland’s daily calculations and fund-transfer controls contained errors from July 2022, leaving its safeguarding account underfunded on a daily basis for at least 18 months. The maximum daily shortfall reached €5.2 million in 2024, while the average daily shortfall was 0.54% of the firm’s safeguarding obligations.
The notice also says the Irish firm outsourced safeguarding to a US Coinbase group company for more than four years without enough local oversight or expertise. Around 30 institutional customers were directed to deposit US dollars into an account held by Coinbase Inc.; the funds were later transferred to Coinbase Ireland’s safeguarding account, meaning they were initially mixed with funds held for customers of another Coinbase entity. The Central Bank said this could have made it harder for users to recover their money in an insolvency.
What does the penalty require?
Coinbase Ireland admitted the breaches and agreed to a reprimand and an initial penalty of €4,646,597, reduced to €3,252,618 after a 30% settlement discount. The settlement notice says the sanctions will take effect only if confirmed by the High Court.
What did Coinbase say about customer losses?
Coinbase said it had resolved the issues and that no customer lost money or was unable to access funds as a result. That addresses actual customer impact; the Central Bank’s case concerns the safeguards that should have protected those funds and the risk the failures posed if Coinbase Ireland had become insolvent.
